RHOA COMMON AREA TREE MANAGEMENT POLICY AND PROCEDURES
The policy of the Riviera Home Owners Association (“RHOA”) is to leave the undeveloped common areas within the Association in their natural condition. The trees in the common areas within the Riviera Association are to be left to grow, die, fall and decay without outside intervention, barring the existence of certain extenuating circumstances. It is recognized that circumstances may arise which would indicate a variance from this policy. That is the purpose of establishing these procedures.
1) If an RHOA Member lot owner adjacent to a RHOA common area believes an unsafe tree condition exists, as a result of natural causes, to real property or humans who may be in close proximity to such tree or trees, such member may submit to the RHOA a written letter request to evaluate the tree to determine if there is an obvious problem that would require the removal of all or a portion of the tree or trees.
2) The homeowner will tag the questionable tree or trees with colored, plastic tape and submit to any Trustee of the RHOA. • A written request for review and consideration addressed to the attention of the RHOA Board of Trustees, and • A copy of a current survey or plat of the homeowner’s property showing clear evidence that the tree or trees in question fall within the RHOA common areas. 3) The RHOA Board will examine the request and physically view the tree or trees in question to determine if a potential danger to the homeowner’s property exists. Please note that the RHOA trustees are not arborists and their decisions are based on their best judgment as volunteer members of the RHOA. 4) All requests to remove RHOA common area trees that are live, fallen, or dead, must be reviewed by the RHOA board and will be done in a manner that maintains common area stability and appearance. Removal of a tree or trees will be reviewed on a case-by-case basis as presented to them. Removal is not guaranteed.
